Welcome to Black Protocol. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Black Protocol Interactive ("Company," "we," "us," or "our") governing your access to and use of the Black Protocol website, game client, services, and related content (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

1. Acceptance of Terms

By creating an account, downloading, installing, or using Black Protocol, you affirm that you are at least 16 years of age (or the minimum age required by your jurisdiction) and that you have read, understood, and agree to be bound by these Terms. If you are accessing the Service on behalf of a legal entity, you represent that you have the authority to bind that entity to these Terms.

Black Protocol is a tactical military first-person shooter game that provides players with:

• Online multiplayer combat gameplay
• Customizable loadouts and weapon systems
• Competitive ranking and matchmaking
• Community features including forums and fan art sharing
• Regular content updates and seasonal events
• Optional in-game purchases and premium content

3. User Accounts and Registration

3.1 Account Creation

To access certain features of the Service, you must create a user account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Not share your account credentials with any third party
• Immediately notify us of any unauthorized use of your account
• Use a strong, unique password for your account

The Company will not be liable for any loss or damage arising from your failure to comply with these requirements.

3.3 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion, including but not limited to:

• Violation of these Terms
• Engagement in prohibited activities
• Inactivity for an extended period
• Legal requirements or court orders

4. User Conduct and Prohibited Activities

You agree not to engage in any of the following prohibited activities:

4.1 Cheating and Exploitation

• Using third-party software, hacks, trainers, or bots to gain unfair advantage
• Exploiting bugs, glitches, or vulnerabilities in the game
• Modifying or reverse-engineering any part of the game client
• Using automated scripts or macros

4.2 Harassment and Abuse

• Harassing, threatening, or intimidating other players
• Using hate speech, discriminatory language, or symbols
• Engaging in toxic behavior, griefing, or team killing
• Spamming, flooding, or disrupting game servers

4.3 Account Trading and Sales

• Selling, trading, or transferring your account to third parties
• Buying or acquiring accounts from unauthorized sources
• Creating multiple accounts to circumvent restrictions

4.4 Intellectual Property Violations

• Copying, distributing, or reproducing game content without authorization
• Creating derivative works based on our intellectual property
• Using our trademarks or branding without permission
• Streaming or recording gameplay for commercial purposes without disclosure

4.5 Illegal Activities

• Using the Service for any illegal purpose
• Violating any applicable laws or regulations
• Engaging in fraud, phishing, or identity theft

5. Virtual Items and Currency

5.1 Virtual Currency

Black Protocol may offer virtual currency ("Black Credits" or "BC") for purchase. You acknowledge that:

• Virtual currency has no real-world monetary value
• Virtual currency is non-refundable except as required by law
• Virtual currency expires upon account termination
• Purchases are final and non-cancellable

5.2 Virtual Items

Items, cosmetics, weapons, and other digital content obtained through gameplay or purchases ("Virtual Items") are licensed to you, not sold. You do not own Virtual Items and cannot transfer them to third parties except through in-game trading systems where available.

5.3 No Refunds

All purchases of virtual currency and Virtual Items are final and non-refundable. Except as required by applicable consumer protection laws, we are not obligated to provide refunds for any reason.

6. Subscriptions and Premium Access

6.1 Subscription Benefits

Black Protocol may offer premium subscriptions ("Black Protocol Elite" or similar) that provide benefits including:

• Exclusive cosmetic items and skins
• Double XP weekends and bonus rewards
• Early access to new content and features
• Priority customer support
• Ad-free experience

6.2 Subscription Billing

Subscription fees are charged recurring on a monthly or annual basis until cancelled. By subscribing, you authorize us to charge your payment method for the subscription fee plus any applicable taxes. Subscription prices are subject to change with 30 days' notice.

6.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of your current billing period. No refunds will be provided for partial billing periods unless required by law.

7. Online Conduct and Player Safety

7.1 Player Reporting

We provide tools for players to report harassment, cheating, and other violations. We review all reports and take appropriate action, which may include:

• Warnings or temporary suspensions
• Permanent account bans
• IP address blocking
• Hardware bans in severe cases

7.2 Communication Guidelines

All in-game chat, voice communication, and community forum posts must comply with our Community Guidelines. We reserve the right to moderate or remove content and take action against users who violate these guidelines.

8. Intellectual Property Rights

8.1 Ownership

The Service, including all content, features, and functionality, is owned by Black Protocol Interactive and is protected by copyright, trademark, and other intellectual property laws. The Black Protocol name, logo, characters, artwork, music, and all related materials are trademarks or registered trademarks of Black Protocol Interactive.

8.2 User-Generated Content

You retain ownership of content you create and submit to the Service, such as fan art, screenshots, and forum posts ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in connection with providing and promoting the Service.

8.3 Streaming and Content Creation

You may stream, record, and share gameplay footage from Black Protocol for non-commercial purposes. Commercial use requires written permission. When streaming or creating content about Black Protocol, you must disclose any sponsorships or paid partnerships in accordance with applicable advertising regulations.

9. Third-Party Services and Links

The Service may contain links to third-party websites, services, or applications that are not owned or controlled by Black Protocol Interactive. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any third-party services.

10. Disclaimers and Limitation of Liability

10.1 "As Is" Basis

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 Service Availability

We do not guarantee that the Service will be available at all times. We may experience interruptions, delays, or errors due to maintenance, technical issues, or circumstances beyond our control. We are not liable for any such interruptions or resulting data loss.

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLACK PROTOCOL INTERACTIVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES.

You agree to indemnify, defend, and hold harmless Black Protocol Interactive and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights

12. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, including removing or adding features, content, or changing pricing. We will provide reasonable notice of material changes when possible.

We may update these Terms from time to time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Black Protocol Interactive is registered, without regard to its conflict of law provisions.

13.2 Dispute Resolution

Any dispute arising out of or relating to these Terms shall first be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be submitted to binding arbitration in accordance with the rules of the applicable arbitration association. Arbitration will be conducted in the primary jurisdiction of the Company.

13.3 Small Claims

Notwithstanding the above, you may bring claims in small claims court if your claims qualify, provided the claims remain in such court and are on an individual (non-class, non-representative) basis.

14. Severability

If any provision of these Terms is held to be unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

15. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16. Entire Agreement

These Terms constitute the entire agreement between you and Black Protocol Interactive regarding the Service and supersede all prior agreements and understandings, whether written or oral.
